المحكمة العليا في السعودية: إلغاء عقوبة الجلد بما "يتفق مع المعايير الدولية لحقوق الإنسان"

أعلنت المحكمة العليا في السعودية إلغاء عقوبة الجلد بما "يتفق مع المعايير الدولية لحقوق الإنسان"، بحسب ما ورد في وثيقة اطلعت عليها وكالة فرانس برس اليوم السبت.

وتواجه المملكة المحافظة انتقادات حادة من منظمات غير حكومية بسبب انتهاك الحقوق الإنسانية وخصوصا عقوبة الجلد التي تفرض في حالات القتل والمساس بـ"النظام العام" وكذلك العلاقات خارج إطار الزواج.

وكتب في الوثيقة الصادرة عن المحكمة والتي لا تحمل تاريخا محددا "قررت المحكمة العليا في نيسان/أبريل 2020 إلغاء عقوبة الجلد من العقوبات التي يمكن أن يحكم بها القضاة".

وأشارت إلى أن القضاة يمكنهم "الاكتفاء بعقوبة السجن أو الغرامة أو بهما معا" ولهم أيضا "بدلا من ذلك الحكم بأي عقوبة بديلة مثل الإلزام بتقديم خدمات اجتماعية ونحو ذلك".

وتفيد الوثيقة أن هذا القرار يأتي في إطار "الإصلاحات والتطورات المتحققة في مجال حقوق الإنسان في المملكة التي جاءت بتوجيهات" من الملك سلمان بن عبد العزيز و"بإشراف ومتابعة مباشرتين" من ولي العهد الأمير محمد بن سلمان.

ويأتي ذلك غداة إعلان ناشطين الجمعة أن الناشط الحقوقي السعودي عبدالله الحامد الذي يقضي عقوبة بالسجن مدة 11 عاما قد توفي في زنزانته.

وفارق الحامد البالغ من العمر 69 عاما الحياة بعد إصابته بنوبة قلبية داخل السجن في وقت سابق هذا الشهر، وفق منظمات عدة تعنى بحقوق الإنسان بينها منظمة العفو الدولية.

وكانت قضية المدون السعودي رائف بدوي في السنوات الأخيرة القضية التي حصلت على أكبر قدر من الاهتمام. فقد حكم على بدوي الذي كان ناشطا في مجال الدفاع عن حرية التعبير في العام 2014 بألف جلدة والسجن عشر سنوات بتهمة "شتم" الإسلام.

ومنحه البرلمان الأوروبي في 2015 جائزة ساخاروف لحرية الفكر ودعا إلى الإفراج عنه فورا.
